SERVICE AGREEMENT

Greensoft Yazılım Üretim San. and Tic. Ltd. Ltd. Hereinafter referred to as Adalar Hosting or adalarhosting website (www.adalarhosting.com). By receiving service from Adalarhosting.com, you will have accepted all of the conditions in this agreement. Adalar Hosting, the creators of any content on this site, their employees, persons and organizations authorized by Adalar Hosting have no criminal or legal liability for any claim regarding any material/moral damage that may arise from your failure to read the terms in question or your failure to act in accordance with them even though you have read them.

Adalar Hosting has the right to update and change this agreement unilaterally at any time without prior notice. All kinds of information, statistical figures and values on the Adalar Hosting Website have been compiled from sources whose reliability is accepted within the framework of general practices, and their accuracy and adequacy are not guaranteed by Adalar Hosting in any way. Adalar Hosting shall not be liable to any personal, legal or There is no criminal liability. 1.) Orders and Service Delivery

Once your order has passed the fraud check and your payment has been received, your account will be established and your information will be sent to you. Although domain name, web hosting and reseller hosting accounts are automatically established for payments made by credit card and PayPal, the installation process may take up to 48 hours in case of a possible problem. For payments made via money transfer or EFT to our bank or postal check accounts, the setup time is determined as 2 business days at most. For VDS and rental server services, installation time is 48 hours unless otherwise stated. The delivery time for software and license services is maximum 1 week unless otherwise stated in writing/orally. If delivery is not made within the specified time, Adalar Hosting has the obligation to refund your fee if you request it. It is your responsibility to provide an e-mail address that you actively use and has no problems with when ordering. In case of any violation of the rules or when we need to reach you, the e-mail address you provide will be used. It is your responsibility to constantly keep your e-mail address updated and checked, all e-mails sent to you are considered as received. Adalar Hosting has no legal or criminal liability for any damage or loss that may occur if the e-mails sent to you are not received or are not read by you. All information in the form you fill out when ordering or registering on our site must be accurate and complete. Adalar Hosting has the right not to refund or partially refund orders canceled due to incorrect information provided. Adalar Hosting may request a credit card photocopy/scanned photo or ID photocopy/scanned photo for security purposes when deemed necessary. If you do not provide these, your order may be canceled and treated as fake, or the service(s) you receive may be stopped. Adalar Hosting has the right not to refund or partially refund accounts suspended due to fraud.

Site Migration

Adalar Hosting does its best to move your site to Adalar Hosting, in services that are guaranteed to move your site. However, since site migration service is an uncertain process, Adalar Hosting does not guarantee that your site will be moved or how long it will take for your site to be moved. Each hosting company has a different configuration and/or some hosting companies do not have the necessary conditions to move a site, so sometimes it can be very difficult or impossible to move your site correctly/completely/error-free. Your site may be moved incorrectly and/or may not be moved at all. Adalar Hosting has no legal or criminal liability for any damages that may arise from this situation.

2.) Content

The conditions of all services provided by Adalar Hosting are regulated in accordance with the Constitution of the Republic of Turkey. By using the services provided by Adalar Hosting, you cannot impose any legal liability on Adalar Hosting, you bear all legal responsibility for every action you take using the services provided to you. It is prohibited to violate any copyright or proprietary rights by using our services. This includes unauthorized music, books, photographs or other copyrighted materials. Additionally, as required by law, pornographic/erotic content and content that can be hacked cannot be hosted. Selling in violation of copyright/registration rights and/or containing pornographic/erotic content will result in the immediate termination of the service(s) you receive. If content that violates copyright/registration rights and/or can be used for hacking is encountered, this content will be deleted or access to the content will be blocked. In case of repetition, the service may be suspended and/or terminated. If you think that such content is hosted using the services offered by Adalar Hosting, you can make a complaint by sending an e-mail to Adalarhosting.com. Adalar Hosting may request more information/documents from you regarding your complaint. In case of complaints regarding illegal actions using the services provided by Adalar Hosting, the service may not be terminated if Adalar Hosting cannot verify the reason for the complaint or is not sure whether the action taken constitutes a crime. Adalar Hosting does not have the legal authority to make decisions. In such cases, you must legally assert your rights against the person who committed this action. Adalar Hosting has no legal or criminal liability for any damage or loss that may occur in such cases. All services offered by Adalar Hosting are for use only within the limits permitted to you. If you in any way access content/file/service that is not permitted to you, it is your responsibility to notify Adalar Hosting before using it. Otherwise, it is your responsibility to cover any material/moral damages you may cause. Adalar Hosting; It may monitor site contents and/or any access for legal reasons, system management purposes, to track unauthorized access, to verify security procedures and/or for operational security purposes. During tracking, content/information may be tested, recorded, copied or used for the purposes described above. Adalar Hosting does not use or share your content in any way other than the purposes described above. Adalar Hosting has the right to provide service to whomever it wishes or not to provide service to whomever it wishes. Adalar Hosting; has the right to delete/block access from our servers of content that is contrary to contract, provocative, divisive, illegal or inappropriate, with or without warning. In such cases, Adalar Hosting has the right not to provide a refund or to provide a partial refund. Illegal content will be reported to the authorized units. Uploading content such as infected content and shell scripts that may harm Adalar Hosting servers may result in your account being terminated completely without a refund. You are responsible for covering all material/moral damages caused to Adalar Hosting and/or other users in these ways. It is entirely your responsibility to ensure the security of your account.

For the services you receive from Adalar Hosting, you are responsible for ensuring that the software and/or scripts/programs installed on your account are safe and that the permissions given to the directories are correct. Users are responsible for every transaction made on their account. This responsibility also includes username and password. You should use a secure and unguessable password for your accounts. Additionally, you are responsible for any malicious software that is uploaded to our servers in any way using your account. In necessary cases, Adalar Hosting has the right to terminate your services without a refund or by providing a partial refund. Adalar Hosting will not accept any legal or criminal liability for any material/moral damages that may occur in this regard. You are responsible for covering all material/moral damages caused to Adalar Hosting and/or other users using your account. Adalar Hosting has the right to request from you the modification of any website, database, account or any other material/service.

3.) SPAM Ban

Adalar Hosting has absolutely no tolerance for sending unsolicited e-mails, bulk e-mails and spam e-mails. If you do not comply with this provision, the service(s) you receive will be terminated with or without notice. All services that cause our IP block to be included in e-mail blacklists will be terminated without notice. Adalar Hosting has the right to demand the necessary fee to correct this situation from the person who caused this if the IP block is included in the e-mail blacklists. This fee is independent of Adalar Hosting and will be used to clear the IP block from email blacklists. By receiving service from us, you agree that in such cases, you will pay the necessary fee within the requested period, without objection.

4.) Payment

As long as you receive service from Adalar Hosting, you agree to pay Adalar Hosting the price of the service you receive. Unless you cancel the service you receive, the service will continue to be renewed and an invoice will be created for the service you receive. If you do not want to continue receiving service, you must indicate that you want to cancel at least 15 days in advance, so your service will be canceled at the end of the day or after the period you have paid, depending on your request. Service cancellation must be made from your customer panel. On the cancellation page, there are options to cancel the service immediately or when it expires.

Adalar Hosting has the right to obtain the fee through legal means for accounts that have not been paid unless canceled 15 days in advance. As long as you receive service from Adalar Hosting, you are responsible for ensuring that your payment information is up to date and paying your invoices on time. If the invoice is not paid on time, Adalar Hosting will give an additional 6 days for the payment of the invoice for web hosting and reseller hosting accounts, and your service will be suspended at the end of this period. The service you receive will be terminated 30 days after the due date. For domain name, VDS and leased server services, if payment is not made by the due date, your accounts will be terminated immediately. Adalar Hosting cannot be held responsible in any way for any material/moral damages or data loss that may arise in this regard. Overpayments made by mistake and/or on purpose will be added to your account as a credit and will not be refunded for any reason. You can use this added credit for the next services you receive from Adalar Hosting. Adalar Hosting reserves the right to change the prices of the products at any time without notice. If the disk space, traffic and similar resources you have purchased are used more than the purchased amount, Adalar Hosting will charge you for the cost of the resources used. In such a case, you are responsible for paying the required fee within the requested period, without objection. If payment is not made, your account will be terminated without a refund and Adalar Hosting will not be responsible for any material/moral damages and data losses that may occur in this regard. In cases of withdrawal (dispute, chargeback, etc.) using payment channels without Adalar Hosting's knowledge and/or permission, it is your responsibility to cover all material and moral damages caused to Adalar Hosting.

5.) Backup and Data Loss

You are responsible for all your data when using our services. Adalar Hosting offers the backup service as a convenience to you, and does not provide any guarantee regarding backups. Adalar Hosting cannot be held responsible for any data loss you may experience for any reason.

6.) Service Cancellation and Refund

Adalar Hosting reserves the right to terminate any service at any time, without giving a reason, with or without notice, without refund or partial refund. Insulting/acting rude behavior to any of our employees will result in suspension/termination of your account/service(s). In such a case, your membership will be terminated and the contract will be terminated without any refund. If you receive service from Adalar Hosting, you undertake to refrain from any comments, behaviors, announcements, posters, writings, words, etc. that may damage the commercial reputation of Adalar Hosting or its employees. In case of contrary behavior, you accept that you are under the obligation of material and moral compensation and that Istanbul Courts and Enforcement Offices have jurisdiction in all cases to be filed in this case. Sites that directly or indirectly damage our servers and/or cause problems such as slowdowns/interruptions or are attacked may be terminated without notice and without a refund. In such cases, Adalar Hosting may request that you compensate for the damage incurred. In such a case, you are responsible for paying the required fee within the requested period, without objection. For paid services, if the service is canceled before the end of the service period (due to use contrary to the service agreement, user request, etc.), the full service fee or the fee for the unused period will not be refunded. You can use the credit in your account for the services you can receive from us, but no refund will be made or credit will be added to your account for services terminated early.

7a.) Use of the Service

7aa.) Web Hosting/Reseller Hosting

Actions not allowed:

  1. a) Sending bulk e-mails and sending SPAM e-mails in any way, for any reason is strictly prohibited. E-mail services are provided for your use only for your normal correspondence.
  2. b) Resource use above 25% for more than 90 seconds is prohibited. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by Adalar Hosting and Adalar Hosting is not obliged to provide any evidence regarding your resource usage.
  3. c) It is forbidden to use more than 5% daily average resources for web hosting accounts and more than 12% daily for reseller hosting accounts. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by Adalar Hosting and Adalar Hosting is not obliged to provide any evidence regarding your resource usage.
  4. d) It is prohibited to run any server-based programs on our servers. It includes server-based programs such as IRCD.
  5. e) It is prohibited to run spider or indexing programs such as Google Cash/AdSpy.
  6. f) It is prohibited to run any software that communicates with IRC (Internet Relay Chat) networks.
  7. g) Running any proxy application is prohibited.
  8. h) Running any bit torrent application is prohibited. You can link to legal torrents outside our servers, but you cannot host them on our servers.
  9. i) Cannot run any file sharing/peer-to-peer applications.
  10. j) Game server applications such as Counter-Strike, Half-Life etc. are prohibited.
  11. k) It is forbidden to run cronjob applications at intervals of less than 15 minutes.
  12. l) It is forbidden to run file sharing software (example: rapidshare etc.).
  13. i) It is prohibited to run audio stream/video broadcast applications.
  14. i) Each web hosting account is limited to receive a maximum of 250,000 files. Accounts with more than 100,000 files are not backed up by us.

7ab.) VDS / Rental Server

Actions not allowed:

  1. a) Sending bulk e-mails and sending SPAM e-mails in any way, for any reason is strictly prohibited. E-mail services are provided for your use only for your normal correspondence.
  2. b) VDS services cannot use resources so intensively that it would damage other VDSs in any way. This problem is usually caused by intense disk activities.
  3. c) Running any proxy application is prohibited.
  4. d) Running any bit torrent application is prohibited. You can link to legal torrents outside our servers, but you cannot host them on our servers.
  5. e) Cannot run any file sharing/peer-to-peer applications.
  6. j) Game server applications such as Knight Online, Counter-Strike, Half-Life etc. are prohibited.

7b.) Backup Limit

The service(s) received by customers who constantly make backups that Adalar Hosting deems unnecessary may be suspended/terminated with or without notice. This article is valid if the server is damaged by using the backup service for purposes other than backup.

7c.) Unlimited Web Hosting

  1. a) Unlimited web hosting services cover only the hosting of your website files and only your website traffic.
  2. b) Unlimited web hosting space cannot be used for data storage and/or backup space.

8.) Traffic Usage

You will have a certain traffic limit depending on the package you purchase. If this limit is filled/exceeded, the purchased service(s) may be automatically suspended until the next month or until more traffic is purchased. It is your responsibility to monitor the traffic used. Unused traffic cannot be carried over to the next month. The usage of the traffic you purchased will be invoiced the following month and you agree to pay this fee within the requested period without objection.

9.) Uptime Guarantee

  If the 99% uptime guarantee guaranteed by Adalar Hosting is not fulfilled, Adalar Hosting is responsible for providing one month free usage for the relevant service, upon your request. Uptime reports reported by third party monitoring software are not valid for Adalar Hosting, Adalar Hosting keeps and publishes uptime reports itself. In cases where the Uptime guarantee is not fulfilled, you must send an e-mail to bilgi@adalarhosting.com to add credit to your account. For VDS and rental server services, only the network is guaranteed; Adalar Hosting is not responsible for ensuring that your VDS or rental server is operational and/or accessible. In such cases, Adalar Hosting will not be aware of the problem unless you notify it. In cases where the uptime guarantee cannot be fulfilled, the discount to be provided for VDS / Rental server services does not include 3rd party software / license fees. The uptime guarantee is not valid during attacks on the server by malicious persons in order to keep the server down and during previously specified server maintenance. For this reason, any outages that occur will not be reflected in the uptime rate.

10a.) Scope of Support

You agree that Adalar Hosting will not provide any support on matters that do not cover the service you receive. Adalar Hosting has no obligation to provide software support or perform user operations (opening an e-mail account/setting up e-mail, creating a database, etc.) for any hosting service received. In VDS/rental server services, support is provided only for restoring the system to its initial delivery state; additional software installations and user transactions are not included in the scope of support. In software services, Adalar Hosting is obliged to deliver only software that works smoothly. In order to benefit from the support system, you must log in to your customer panel with your password and send a support notification from the Support Notifications section. No account-related information is shared or any transactions are taken through other means (e-mail, phone, live support, contact form, etc.).

10b.) 24/7 Support and Support Delivery Time

The concept of 24/7 support does not mean that you will be available every time you call/get an instant response to your support notifications. Our support team tries to respond to your reports as quickly as possible. 24/7 support indicates that you work without adhering to working hours, and depending on the workload of the support team, the response you will receive to your support notification will be 24 hours at most, unless exceptional circumstances occur.

11.) Reseller Hosting: Customer Responsibility

If you are getting a reseller hosting account, you are responsible for supporting your own customers. Adalar Hosting will not provide support to customers of reseller hosting users. If a customer of any of our reseller hosting users contacts us, Adalar Hosting has the right to suspend your account until we deal with your own customer. In addition, our reseller hosting users are responsible for the content of their customers' sites. Adalar Hosting cannot be held responsible in any way for the illegal behavior and contractual behavior of reseller hosting users and their customers.

12.) VDS and Dedicated Server

Adalar Hosting reserves the right to reset the password of any VDS or rental server service it offers. It is the customer's responsibility to have a valid e-mail address and root password registered in our system. VDS and rental servers are not backed up by us, all data and data backup are the responsibility of the customer.

13.) Co-Location (Server Hosting)

Adalar Hosting reserves the right to reset the password of any server hosting service it offers. It is the customer's responsibility to have a valid e-mail address and root password registered in our system. The hosting service recipient is not backed up by us; it is the customer's responsibility to back up all data and data. Adalar Hosting reserves the right to hold the hosted server and other equipment hostage in case of payment delays that may occur in server hosting services until the payment is made with legal interest.

14.) Price Change

You will not be charged an additional fee for the service you purchased, during the service period you purchased, unless you purchase an additional feature or use it beyond the permitted limits. Adalar Hosting reserves the right to change prices at the end of the service period and renew the service with new pricing.

15a.) Compensation for Damage

By receiving service from Adalar Hosting, you agree that you will not harm Adalar Hosting in any way or cause any material/moral damage, and you undertake to compensate for any material/moral damage caused.

15b.) Legal Obligations

By receiving service from Adalar Hosting, you agree not to give Adalar Hosting any legal liability. In such a case, you undertake to cover all court and attorney expenses within the requested period.

16.) Disclaimer

Adalar Hosting cannot be held responsible for any damage that may occur to your business. Adalar Hosting does not offer any guarantee regarding the service(s) it provides. These include data losses, delays, interruptions, incorrect information delivery caused by Adalar Hosting and any Adalar Hosting staff. Adalar Hosting will not accept responsibility if your data/information is obtained by third parties in the event of a hacking incident.

17) Providing Legal Information

Adalar Hosting is obliged to provide all requested information to legal authorities when necessary. This information, when necessary, may also be your private information.
